A consequence of not serving a party wall notice

Roadrunner Properties Limited v Dean, 21 November 2003 (Court of Appeal).

The Court of Appeal has given guidance on how a court should view expert evidence on causation of damage to property where the alleged cause is works to a party wall in circumstances where the party carrying out the works failed to serve the adjoining owner with the requisite notice under the Party Wall etc. Act 1996.
