We have a new Practice note, Marine Strategy Framework Directive: implementation in the UK (www.practicallaw.com/9-519-5272), which explains:

  • The requirements in the Marine Strategy Framework Directive (Directive 2008/56/EC establishing a framework for community action in the field of marine environmental policy) for member states to:

    • achieve good environmental status in their marine waters by 2020; and

    • develop marine strategies to achieve that goal.

  • How the Marine Strategy Framework Directive is implemented by the Marine Strategy Regulations 2010 (SI 2010/1627) in the UK.

The UK government is currently consulting on the first stages of the UK's marine strategy. The Secretary of State and the devolved administrations will be required to consider the marine strategy when exercising their functions in relevant marine waters, including planning permission for developments such as offshore wind installations.
